This
is your Discount Cash Card! TM (the Card) Agreement. Please read
it carefully and keep it for your records. You do not have to sign
this agreement. By accepting and using your card you agree to be
bound by these terms and conditions.
Terms - In this agreement, the terms Bank, we, us, and our shall mean the bank that has agreed with Secured Cash Network (Provider) to issue the card to you in connection with Provider ATM Cash Card Program (Card Program). The terms you and your shall mean the person or persons in whose name the Card is issued and shall include any person you authorize or permit to use the Card. The term Account shall mean the account established for your Card. The term Card shall mean the ATM debit card issued by us. This Agreement states the terms and conditions governing the use of the Card. The Card has been issued to you under the laws of the United States and the State of Texas by First Federal Bank of Roswell, New Mexico or one of its affiliates. The initial use, signing, or other acceptance of the Card or use of any other service by you or any person you authorize, constitutes acceptance of the following terms and conditions.
Use of the Card - You may use your Card using your four (4) digit PIN that is required for each transaction at ATM machines or merchants accepting the Card. You may use your five (5) digit Access PIN to access information online or via our Voice Response Unit (VRU). You assume responsibility for all transactions arising from use of the Card by any person you have authorized or otherwise permitted to do so. The PIN is your Personal Identification Number. Communicating your PIN to any individual constitutes your authorization of that individual for unlimited use of your card. Never communicate your PIN by voice or in writing. Provide your PIN only to established merchants by keystroke into a secure electronic system. If you have authorized another person to use the Card in any manner, that authorization shall be deemed to include the authorization to make withdrawals or transfers of funds from your Account, and such authorization shall be deemed to continue until you have taken all steps necessary to revoke it by preventing such use by that person and contacting us. Treat your Card like cash. If you lose your card you may obtain a replacement card for a fee, but you must provide your card number and PIN. The Card and associated EFT (Electronic Funds Transfer) services are made available for your convenience and, except to the extent provided by applicable law, we will not be liable for the unavailability of or failure to operate all or any part of the EFT services system, including any ATM terminal, POS terminal, card authorization terminal, or other link in the authorization system.
We will also not be liable for the refusal of any ATM service provider or merchant or bank to honor a Card. We will not be liable for any personal injury or tangible property damage suffered or incurred by you through use or attempted use of your Card. Your rights relating to refunds and returned merchandise are the same as when you pay cash or check. You must resolve issues of this type directly with the merchant. It is the merchant’s own policy on refunds and returns that governs these transactions. All transactions arising from the authorized use of the Card shall be subject to and controlled by the terms of all applicable Account agreements and other contractual relationships with us and all applicable rules and regulations, as amended from time to time. You acknowledge and agree that the Card has been provided to you in connection with the Card Program solely at the discretion of the Provider. Except as otherwise may be prohibited by any law, rules, or regulations, you agree that the Provider are solely responsible for any and all aspects of the Card Program and you agree to hold Bank and its representatives harmless from any claim arising out of your receipt of the Card and the Card Program administered by Provider.
Use of the Account - The Card is intended for use for PIN-based merchant and ATM transactions or funds transfer via VRU or on-line only, and therefore no checks can or will be obtained by you in connection with the card. You agree the Account will be debited for all purchases made, services rendered, and cash withdrawals, together with any fees and charges attributable thereto. You understand and agree that you are liable for all transactions made on your Account, including all transactions made by any authorized user. Interest, dividends or other earnings or returns will not be paid to you for any value loaded on the card. There is no credit card, credit line, overdraft protection, or deposit account associated with the card. The value associated with the card is not insured by the Federal Deposit Insurance Corporation (FDIC).
Cancellation; Suspension of Use - Bank, in its sole and absolute discretion, may limit your use of the Card. Bank may refuse to issue a Card or may revoke the Card privileges with or without cause or notice, other than any required by applicable law. The Card remains the property of the Bank at all times and may be repossessed by Bank at any time. We may also suspend use of the Card at any time and for any reason. If we decide to cancel or suspend use of the Card, we will attempt to notify you by U.S. mail or electronic mail. Upon cancellation of the Card privileges, use of the Card must be immediately discontinued. Bank's cancellation of Card privileges will not affect your rights and obligations pursuant to this Agreement. If we cancel or suspend your Card privileges through no fault of yours, you will be entitled to a refund of any remaining balance as provided in this Agreement.
Amendment and Termination - We reserve the right to amend and modify this Agreement. Any amendment or modification shall become effective on the date specified therein. Unless prohibited by applicable law, changes will apply to existing balances as well as to new balances. We may terminate this Agreement and/or cancel the card at any time without notice for suspicion of fraudulent use. Use of the Card after notice of its expiration or cancellation is fraudulent and will subject you to legal proceedings
Fees - The schedule of fees associated with the use of this card has been provided as part of this agreement.
Restrictions on Card Transactions - When making a merchant purchase and/or ATM transaction, you authorize us to debit from your designated account the total amount of the transaction as shown on any sales draft or withdrawal order plus any applicable fees originated by use of your Card, whether or not signed by you.

Disclosure of Account Information to Third Parties - We will not disclose information to third parties about your Account or the transfers/transactions that you make, except in the following circumstances: Where it is necessary for completing the merchant or ATM transfer/transaction; or in order to verify the existence and condition of your account for a third party, such as a merchant; or in order to comply with government agency or court orders; or if we, in good faith, believe you have given us your written permission; or in the investigation of alleged fraudulent activity concerning your Account; or in the prosecution of alleged fraudulent activity concerning your Account.
Your Liability for Unauthorized Transfers - You assume responsibility for all transactions arising from use of the Card by any person you have authorized or otherwise permitted to do so. The PIN is your Personal Identification Number. Communicating your PIN to any individual constitutes your authorization of that individual for unlimited use of your card.
General Account Disclosures - If we are served with any legal process which affects the Account, we may, without liability, suspend payment on the Account and any other account which we believe to be affected thereby until final determination of such legal proceeding or appropriate resolution of the adverse claim, even though the suspension of payment may have been due to inadvertence, error on the Account, or similarity of names of the Account owner. We shall not be liable for your damages by reason thereof, providing we have acted in good faith. Our determination of your Account balance may be made by a single determination at any time from presentment to the time we are required to make the determination.
Unclaimed Property - If we have no record of transactions on the Card for several years, applicable law requires us to report the balance on the Card as unclaimed property. If this occurs, we will try to locate you at the address shown in our records. If we are unable to locate you, we may be required to deliver any value remaining on the Card to the State of issue as unclaimed property. We may deduct a Dormancy Fee, as permitted by law and described in the "Schedule of Fees and Charges."
Periodic Statements - Electronic history of Card transactions will be made available at the www.securecashnetwork.com website. You agree that these are reasonable procedures for sending and receiving periodic statements.
Disclaimer Of Warranties - Except as expressly otherwise provided in this agreement, we make no representations or warranties of any kind to you, whether express or implied, regarding the card, customer service functions, or any other subject matter of this agreement, including, without limitation, any implied warranties of merchantability or fitness for a particular purpose.
Limited Liability - Except as otherwise expressly required by this agreement or applicable law, we will not be liable to you for performing or failing to perform any obligation under this agreement unless we have acted in bad faith. Without limiting the foregoing, we will not be liable to you for delays or mistakes resulting from any circumstances beyond our control, including, without limitation, acts of governmental authorities, national emergencies, insurrection, war, riots, failure of merchants to honor the reference card or the physical card, failure of Provider to provide any services, failure of merchants to perform or provide services, failure of communication systems, or failures of or difficulties with our equipment or systems. Not in limitation of the foregoing, we will not be liable to you for any delay, failure or malfunction attributable to your equipment, any Internet service, any payment system or any customer service function. In the event that we are held liable to you, you will only be entitled to recover your actual damages. In no event shall you be entitled to recover any indirect, consequential, exemplary or special damages (whether in contract, tort or otherwise), even if you have advised us of the possibility of such damages.
Privacy Policy - This Privacy Policy of the Provider includes examples of the types of nonpublic personal information we collect and with whom we may share such information. These examples are illustrative and should not be considered a complete inventory of our information collection, use and sharing practices. In addition, you may have other privacy protections under some state laws.
Information We May Collect
In order to provide you with products and services you have requested, to service the Card, and as we deem appropriate to determine your eligibility for products or services, the Provider collect or reserve the right to collect the following types of nonpublic personal information about you from the following sources: (a) Information we receive from you (or is provided to us on your behalf) including but not limited to your name, address, telephone number and date of birth; (b) Information about your transactions with us or others, such as the balance on the Card, payment history, parties to transactions and Card usage; (c) Information we receive from a consumer-reporting agency, such as your creditworthiness and credit history.
Disclosures Permitted by Law -
SCN may disclose all of the nonpublic personal information described above, as permitted by law. For example, we may use affiliates or vendors of SCN to perform services for us, such as providing customer assistance, processing your Card transactions, preparing monthly statements describing activity on the Card and maintaining or developing software for us. We also may disclose information in response to requests from law enforcement agencies or state and federal banking regulators.
Choice of Law; Severability - The laws of the United States and the laws of Texas govern this Agreement regardless of your place of residence. This Agreement as it relates to use of the Card shall act as a contractual modification of the Uniform Commercial Code, to the extent permitted by law. If any provision of this Agreement is held to be invalid or unenforceable for any reason, it shall not affect the validity or enforceability of any other provision of this Agreement.
The following table shows the service charges that apply to various uses of your Card. These charges will be deducted from the card balance when they occur. The charges do not include any ATM machine service fees that may be charged by the machine owner or fees charged by any bank or third party for the loading of your card.

* Charged each
month once account is activated and continuing until account is
closed. Cards will be automatically debited this amount on the 1st
day of the month following the month the Card was activated.

If the account goes 180 consecutive days with no activity, the
account becomes inactive. This fee will be charged for each calendar
month the account is inactive.
After nine (9) consecutive months with no activity or a zero balance, the account will be closed.
Card Research and Special Requests: Should you request that we perform research or handle special requests relating to the Card, there will be a charge of up to $25 per hour for each request. Should your request be the result of a billing error or unauthorized transaction, this service is free.
